Terms of Service

By using Ah Yer! Philippines (www.ahyer.com and all constituent pages, hereinafter "the Web site"), a World Wide Web-based information databasing service provided by the operator of the Web site (hereinafter "the Operator"), the user of the Website, defined as any individual, corporation, or organization directly or indirectly accessing information published on the World Wide Web by the Web site, in whole or in part, by any means (hereinafter "the user"), automatically agrees to be bound by the following terms and conditions ("Terms of Service").

Jurisdiction

This operation of the Web site falls under the legal jurisdiction of the Republic of the Philippines. The user's usage of the Web site constitutes an agreement to abide and be bound by the laws of Republic of the Philippines.

Scope of Instrument

While this document outlines the basic Terms of Service and the acceptable usage policy for the Web site, the existence of this document does not imply that the Operator countenances any or all activity or usage not explicitely covered by this document. Overview

The Web site is a public forum for the purposeses of sharing business information. The user is solely esponsible for the information the user submits to and makes available on the Web site. While the Web site provides the means for the user to share information, the Web site and the Operator is in no way responsible for the content of the information, how the user or others use the information, nor the direct or indirect effect of the information on the user or others. In short, the Operator has no control over the information available on the Web site, and does not in any way guarantee nor endorse said information. The user must verify any important information derived from the Web site independently, directly with the original source of said information.

Fees Usage of the Web site is completely free of charge, and no fees shall be charged to the user for creating an account, adding properties, account upgrades, or any other function or service. No fees will be introduced for any type of user function or service. The Web site will not solicit fees, subscriptions, commissions, penalties, upgrade costs, or any other charges from the user at any time. The user will not be invoiced for any activity related to usage of the Web site.

Basic Regulations

The user shall immediately desist from continued access to the Web site should the user not fully understand, or agree to abide by, the Terms of Service.
The user alone is responsible for keeping the user's password secure, and for the information the user posts to the Web site.
The user may not use the Web site mainly for canvassing or soliciting other users. The user may contact those users representating properties with legitimate inquiries only. Using the Web site to actively try and sell or promote any good or service, of whatever nature, by using the contact form or other means of direct communication, to contact other users offering properties, is not acceptable. In other words, users may passively promote their business by listing properties, but may not go from user profile to user profile, sending out offer after offer.
The user may not use the Web site to abuse, harass, or threaten any individual, corporation, organization, or religious belief.
The user may not use the Web site to communicate information of a derogatory, racist, sexist, or discriminatory nature to any individual, corporation, organization,
The user may not use the Web site to communicate information of a sexual or suggestive nature to any individual or to the public in general.
The user may not knowingly insult or offend any user or third-party individual, corporation, or organization, or any religious belief.
The user may not use the Web site to defraud, deceive, or otherwise mislead any individual, corporation, or organization.
The user may not use the Web site to libel any individual, corporation, or organization, or to publish misinformation about any individual, corporation, or organization.
The information the user submits to the Web site must be true and accurate to the user's knowledge. Any information of doubtful vericacy may not be submitted to the Web site.
The user must comply fully with all instructions or restrictions imposed by any form of communication by the Operator or their representatives, such as, but not limited to, administrative staff.

Failure to comply fully with any of these terms may result in the immediate forced closure of the user's account, the assertion by the Operator of the right to deny the user service, to make public relevant information, and/or to notify relevant authorities.

Basic Conditions

For security purposes, the Operator reserves the right to refuse service to the user or any other individual, corporation, or organization, at all times, without prior notice and without providing an explanation.
The Operator is in no way obliged to maintain or operate the Web site. the Operator reserve the right to shut down all services and availability of all or any functionality of the Web site, at any time, without prior notice or explanation, for any duration.
Any information the user submits to the Web site, other than the user's email address or password, may be irreversibly made public.
The Operator reserves the right to permanently and irreversibly edit, delete, destroy, or modify any or all information submitted by any user, without providing any notification or explanation to the user.
The Operator reserves the right to monitor, intercept, or delete messages sent via the Web site's communication systems, if deemed necessary or appropriate, without notification or explanation to the affected user(s).

Copyright

The user may not upload any material to the Web site which infringes on a third party's intellectual property rights. It is the users responsbility to ensure that the uploading or posting of information to the Web site does not violate any copyright. By uploading material to the Web site, the user agrees that the Operator have the right to publish the material on the Web site.

The copyright of all and any material found on this website is the exclusive property of either the respective users or the Operator of the Web site, unless otherwise stated. The information on the Web site, including but not limited to text, data, and digital photographs, may not be copied, stored, downloaded, forwarded, or otherwise distributed. No material found on, at, or within the Web site is in the public domain unless otherwise stated. The user may only access the information on the Web site (such as but not limited to text, data, or digital photographs) by accessing the Web site.

Liability

Any direct or indirect usage of any form of information provided by the Web site construes acknowledgement that the Operator is not liable for any consequences arising from the usage of the Web site. The Operator provides no warranty, guaranty, guarantee, or any other protection regarding the use of the Web site, the use of information derived from the Web site. The user uses the Web site solely at his, her, or their own risk.
